DMCA Policy and Copyright Takedown Procedure

StudyUpload respects the intellectual property rights of authors, publishers, and educational institutions. We comply with the Digital Millennium Copyright Act of 1998 and respond promptly to valid takedown requests. This page explains how to file a notice, what we do when we receive one, and how to file a counter notice if your material was removed in error.

Submit a DMCA takedown notice

If you are the copyright owner or an authorized agent and you believe a file on StudyUpload infringes your copyright, send a written notice that includes all of the following information. Incomplete notices will be returned for clarification before any action is taken.

  1. Your full legal name, mailing address, telephone number, and email address.
  2. A description of the copyrighted work you claim has been infringed. If multiple works are involved, a representative list is acceptable.
  3. The exact URL of every file on studyupload.com that you want removed. Generic site URLs cannot be processed.
  4. A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, an agent, or the law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner behalf.
  6. Your physical or electronic signature.

Send the completed notice to our designated copyright agent at dmca@studyupload.com. We acknowledge receipt within one business day.

What happens after we receive a valid notice

We remove or disable access to the identified file within twenty four hours of confirming the notice is valid. We notify the user who uploaded the file, provide them a copy of the notice, and give them an opportunity to respond. Repeat infringers have their accounts suspended in line with our terms of service. We log every takedown action and keep records for at least one year for audit purposes.

Filing a counter notice

If you believe your material was removed in error, for example because the upload qualifies as fair use under 17 U.S.C. 107, you may submit a counter notice. Include your name, address, phone number, the URL of the removed material, a statement under penalty of perjury that the removal was a mistake, and your consent to the jurisdiction of a federal district court. We forward valid counter notices to the original complainant. If they do not file suit within ten to fourteen business days, we may restore the file.

Misuse of the DMCA process

Filing a knowingly false takedown notice is a federal offense under section 512(f) of the DMCA and may result in liability for damages. Please consult an attorney if you are unsure whether your claim is valid. Repeat infringer policy

StudyUpload terminates the accounts of users who receive multiple substantiated copyright complaints. The first valid complaint results in a warning. The second results in a temporary suspension. The third results in permanent termination of the account and any associated balances or credits.

Can I send the notice from a free email address?

Yes, but we may ask for additional verification if the claim is contested. Notices sent from a domain that matches the copyright owner are processed faster.

What if a student uploaded my course slides?

Send a takedown notice with the URL of every affected file. Course slides distributed only to enrolled students are usually still your protected work and we will remove them.

Do you respond to takedowns from outside the United States?

Yes. We process notices that comply with the DMCA from any jurisdiction. We also respond to similar legal frameworks such as EU notice and action and the United Kingdom Online Safety Act.
